Terms of Service

1. Acceptance of Terms

By accessing or using the Khojj platform ("Platform"), including our website, mobile applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. Khojj reserves the right to update these Terms at any time, and continued use of the Platform after changes constitutes acceptance of the revised Terms.

When you check the consent box during registration and click Create Account, you are entering into a legally binding agreement with Khojj. We record the date, time, IP address, and version of these Terms you accepted as evidence of that agreement.

2. Account Terms

• You must be at least 18 years old to create a Khojj account.
• You are responsible for maintaining the security of your account and all activities under it.
• You must provide accurate and complete information during registration.
• One person or legal entity may not maintain more than one seller account without prior approval.
• Khojj may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Marketplace Rules

Khojj is a marketplace platform connecting Nepali community sellers and buyers across multiple countries, including the United States, United Kingdom, Australia, and Nepal. We facilitate transactions but are not a party to the sale itself.

• All listings must accurately represent the products or services being offered.
• Prices must include all mandatory fees; hidden charges are prohibited.
• Communication between buyers and sellers should remain respectful and professional.
• Khojj reserves the right to remove listings that violate our policies without notice.

4. Seller Terms

• Sellers must comply with all applicable local, state, and national laws in their country of operation.
• Sellers are responsible for the accuracy of product descriptions, images, pricing, and inventory levels.
• Sellers must fulfill orders within the stated processing time or communicate delays promptly.
• Khojj charges a commission on completed sales as outlined in the Seller Dashboard. Commission rates may vary by category and country.
• Sellers are responsible for collecting and remitting any applicable sales tax or VAT.
• Sellers grant Khojj a non-exclusive license to use product images and descriptions for marketing purposes.

5. Buyer Terms

• Buyers are responsible for reviewing product listings carefully before making purchases.
• Payment must be made through Khojj's approved payment methods.
• Buyers must provide accurate shipping information. Khojj is not liable for failed deliveries due to incorrect addresses.
• Disputes with sellers should be raised through the Khojj resolution center before initiating chargebacks.

6. Event Ticketing Terms

Khojj facilitates the sale of event tickets on behalf of event organizers. The following terms apply:

• Event organizers are solely responsible for the event, its content, and its execution.
• Ticket purchases are subject to the refund policy set by the event organizer, as displayed on the event page.
• Ticket resale is permitted only where explicitly allowed by the event organizer.
• Khojj is not liable for event cancellations, changes in schedule, or the quality of the event experience.
• Digital tickets must be presented (via the Khojj app or printed) at the venue for entry.

7. Prohibited Items & Activities

The following are strictly prohibited on Khojj:

• Illegal goods, counterfeit products, or items that infringe intellectual property rights.
• Weapons, explosives, controlled substances, or hazardous materials.
• Items that promote hate, discrimination, or violence.
• Adult or explicit content.
• Price gouging, bid manipulation, or shill bidding.
• Spam, phishing, or any attempt to defraud other users.
• Circumventing Khojj's payment system to avoid fees.

8. Intellectual Property

The Khojj name, logo, website design, and all original content are the intellectual property of Khojj and may not be used without written permission. Users retain ownership of content they upload but grant Khojj a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Platform.

9. Payments and Processing

Payments are processed by Stripe, Inc. By making or receiving payments through Khojj, you also agree to Stripe's Connected Account Agreement, which includes the Stripe Services Agreement. Khojj does not store your full payment-card details. Currency conversion, processing fees, and chargeback fees are determined by Stripe and the issuing bank. Sellers authorize Khojj to debit refunds and chargebacks from their payout balances or — where balances are insufficient — to recover those amounts directly.

10. Disclaimers and Limitation of Liability

Khojj provides the Platform "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law:

• Khojj is not liable for any indirect, incidental, special, consequential, or punitive damages.
• Khojj does not guarantee the quality, safety, or legality of items listed.
• Khojj is not responsible for the conduct of any user on or off the Platform.
• Khojj does not guarantee uninterrupted or error-free operation; scheduled maintenance and unforeseen outages may occur.
• Our total liability for any claim shall not exceed the greater of (a) the fees paid by you to Khojj in the 12 months preceding the claim or (b) USD 100.

11. Indemnification

You agree to indemnify and hold harmless Khojj, its affiliates, officers, employees, and agents from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your use of the Platform, (b) your violation of these Terms or any law, (c) your infringement of any third-party right, or (d) any content or items you list, sell, ship, or transact on the Platform.

12. Dispute Resolution

If a dispute arises between you and Khojj, we encourage you to contact us at support@khojj.com first. If we cannot resolve the dispute informally, both parties agree to resolve claims through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. Class action lawsuits and class-wide arbitrations are not permitted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles. For users outside the United States, local consumer protection laws may apply to the extent they cannot be waived by contract.

14. Changes to Terms

Khojj may modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
